- 1 DEFINITIONS
Working days – days from Monday to Friday, with the exception of public holidays. Account – a free of charge function of the Store regulated by separate terms and conditions (a service provided electronically), through which a Buyer may set up their individual Account at the Store. Consumer – a consumer in accordance with provisions of the Civil Code. Buyer – any person or entity making a purchase at the Store. Terms of Service – these Terms of Service. - 3 TECHNICAL REQUIREMENTS
The correct functioning of the Store requires the following:
a device with access to the Internet
an Internet browser with support for JavaScript and cookie files.
Apart from the requirements specified in item 1 above, an active e-mail account is required for placing an order at the Store.
- 4 PURCHASES AT THE STORE
Prices of goods visible on the Store website are total prices of goods, which include VAT tax.
The Seller notes that the total order price consists of: the price of goods stated on the Store’s website and, if applicable in the given instance, the cost of goods delivery.
The goods selected for purchase must be added to the Store cart.
Afterwards, the Buyer must choose from the options available at the Store: a method of goods delivery and a method of payment for the order, as well as provide the data required to carry out the placed order.
An order is considered placed upon confirmation of its content and the Buyer’s acceptance of the Terms of Service.
Placement of an order is tantamount to conclusion of a sales contract between the Buyer and the Seller.
In order to make purchases at the Store it is necessary to register at the Store website, i.e. set-up an Account.
- 5 PAYMENTS
Depending on the Buyer’s choice, a placed order may be paid for using the following methods:
Via a regular transfer to the Seller’s bank account.
Using the payment platform:
Shopper Payments
Optionally, cash on delivery, i.e. cash paid upon delivery of the goods to the Buyer.
Card or cash upon personal collection of the goods.
In the event of choosing payment using the Płatności Shopper platform, the entity providing online payment handling services is the company Blue Media S.A.
In the event of the Buyer choosing payment upfront, the order should be paid for within 3 Working Days from the date of order placement.
The Seller informs that in the case of certain payment methods, due to their specific nature, payment for the order using this method is possible only directly after placement of an order.
- 6 ORDER PERFORMANCE
The Seller undertakes to deliver the goods without defects.
The order performance time is specified on the Store website.
If the Buyer has chosen the option to pay for the order upfront, the Seller shall commence performance of the order upon receipt of the payment.
If the Buyer purchases goods with varying terms of delivery as part of a single order, the order shall be carried out within a time corresponding to the product with the longest delivery term.
Goods are delivered exclusively within the territory of the Republic of Poland.
Goods purchased at the Store are delivered depending on the delivery method chosen by the Buyer:
Via a courier company
To InPost parcel stations
The buyer may collect the goods personally at the company’s office during opening hours.
If the Buyer chooses the personal collection option, the goods shall be ready for collection within the specified order performance term or, within a goods shipping term provided by the Seller.
- 7 RIGHT TO WITHDRAW FROM A CONTRACT
A consumer has the right to withdraw from a contract concluded with the Seller via the online Store subject to § 8 of the Terms of Service, within 14 days without any statement of cause.
The time to withdraw from a contract expires after 14 days from:
the date on which the Consumer has come into possession of the goods or, on which a third party other than the carrier and specified by the Consumer has come into possession of the goods.
the date on which the Consumer has come into possession of the final item or, on which a third party other than the carrier and specified by the Consumer has come into possession of the final item in the event of a contract involving the obligation to transfer ownership of several items delivered separately.
conclusion of the contract – in the event of contracts for the delivery of digital content.
In order for the Consumer to be able to exercise the right to withdraw from a contract, they must inform the Seller of their decision to withdraw from a contract using the data provided in § 2 of the Terms of Service, by way of an explicit statement (for example, a letter sent via post or information transmitted via electronic mail).
A Consumer may use the contract withdrawal form template available at the end of the Terms of Service, however, this is not mandatory.
To meet the term of withdrawal from the contract it is sufficient for the Consumer to send information concerning their exercise of the right to withdraw from the contract prior to the expiry of the withdrawal term.
EFFECTS OF WITHDRAWAL FROM A CONTRACT
In the event of withdrawal from a concluded contract, the Seller refunds to the Consumer all payments received, including the costs of goods delivery (with the exception of additional costs arising from a delivery method chosen by the Consumer other than the least expensive, regular method of delivery offered by the Seller), without delay, and in any case no later than 14 days from the date on which the Seller has been informed of the Consumer’s decision to exercise the right to withdraw from a contract.
The Seller shall refund the payments using the same payment methods as used by the Consumer in the original transaction, unless the Consumer agrees to another solution; in each case the Consumer shall not incur any fees in connection with such refund.
The seller requests return of goods to the address: ul. Sytkowska 45, 60-413 Poznań without delay, in any case no later than 14 days from the date on which the Consumer has informed the Seller of their withdrawal from a sales contract. This term is considered met, if the Consumer sends the goods back before the expiry of said 14 days.
The Consumer bears the direct costs of returning the goods.
The Consumer is liable only for deterioration of the value of goods which may arise from use of the goods in a way other than is necessary to ascertain the nature, properties and functioning of the goods.
If, due to their specific nature, the goods cannot be sent back using regular mail, the Consumer shall also be required to incur the direct cost of returning the goods. The Seller shall inform the Consumer of the estimated amount of such costs in the goods description on the Store’s website or during placement of an order.
- 8 EXCEPTIONS TO THE RIGHT TO WITHDRAW FROM A CONTRACT
A Consumer is not entitled to the right of withdrawal from a contract concluded remotely in relation to a contract:
whose object is the provision of a non-prefabricated item, manufactured according to the Consumer’s specifications or serving the purpose of satisfying their individualized needs.
whose object is the provision of an item which is highly perishable or characterized by a short fitness for use.
whose object is the provision of an item delivered in sealed packaging which, upon opening, cannot be returned due to reasons of health protection or hygiene, if the packaging has been opened after delivery.
whose object is the provision of items which, upon delivery, due to their nature, become inseparably connected with other items.
whose object is the provision of audio or video recordings or computer software delivered in sealed packaging, if such packaging has been opened after delivery.
concerning the delivery of journals, periodicals or magazines, with the exception of subscription contracts.
in which the price or remuneration depends on financial market fluctuations, which are beyond the control of the Seller, and which may occur prior to the contract withdrawal term.
concerning the delivery of digital content which is not stored on a physical medium, if the fulfilment of delivery has commenced with the explicit consent of the Consumer prior to the expiry of the contract withdrawal term and upon being informed by the Seller of the Consumer’s loss of the to withdraw from the contract.
- 9 COMPLAINTS
In the event of the occurrence of a defect with the goods, the Buyer has the option to submit a complaint concerning the defective goods on the basis of a warranty or guarantee regulated in the Civil Code, provided a guarantee has been granted.
Using a warranty, the Buyer may, on conditions and in terms specified in the Civil Code:
submit a statement concerning price reduction
in case of a significant defect - submit a statement of withdrawal from the contract
request replacement of the item with one free of defects
dement removal of the defect
The Seller requests submission of complaints based on warranty to the Seller’s postal address or e-mail address provided in § 2 of the Terms of Service.
If it is necessary, for the purpose of investigating the complaint, to deliver the goods subject to complaint back to the Seller, the Buyer undertakes to deliver such goods, in case of Consumers – at the Seller’s cost, to the address ul. Sytkowska 45; 60-413 Poznań.
If an additional warranty has been granted for the goods, information of said warranty and its conditions is available in the product description on the Store’s website.
Complaints concerning the functioning of the Store should be directed at the e-mail address provided in § 2 of the Terms of Service.
Processing of complaints by the Seller shall take place within up to 14 days.
EXTRAJUDICIAL METHODS OF SETTLING COMPLAINTS AND ASSERTING CLAIMS
If the complaint procedure fails to provide the result expected by the Consumer, the Consumer may, among others, take advantage of:
mediation conducted by the relevant local Regional Inspectorate for Trade Inspection, which should be addressed with a request for mediation. As a general rule, the proceeding is free of charge. A list of inspectorates can be found here: https://www.uokik.gov.pl/wazne_adresy.php#faq595.
assistance of the relevant local permanent amicable consumer court operating at the Regional Inspectorate for Trade Inspection, which should be addressed with a request to examine the matter by an arbitration court. - 10 PERSONAL DATA
The Seller is the Controller of personal data provided by the Buyer while using the online Store.
The Buyer’s personal data are processed primarily on the basis of a contract and for the purpose of its performance, in compliance with rules stipulated in the European Parliament and Council (EU) general data protection regulation (GDPR). Detailed information concerning data processing by the Seller is included in the privacy policy available at the Store’s website.
- 11 RESERVATIONS
The Buyer is not allowed to submit content of an illegal nature.
Every order placed at the Store constitutes a separate sales contract and requires separate acceptance of the Terms of Service. The contract is concluded for the duration and purpose of performing the order.
Contracts concluded on the basis of these Terms of Service are concluded in Polish.
No provision of these Terms of Service excludes or in any way limits the Consumer’s rights arising from legal regulations.
Provisions concerning goods and sales contracts are applied appropriately to digital content, and contracts for the provision of digital content, unless the Terms of Service state otherwise in such matters.
- 12 PROVISIONS CONCERNING BUYERS WHO ARE NOT CONSUMERS
The right to withdraw from a contract concluded remotely is not granted to entities other than Consumers.
Any liability of the Seller towards the Buyer who is not a Consumer is limited to the value of the order placed by the Buyer.
The Sellers warranty liability towards a Buyer who is not a Consumer is limited to a period of one year following release of the goods to the Buyer.
In the event of a possible with a Buyer who is not a Consumer, the matter shall be settled by a court of appropriate jurisdiction over the registered office of the Seller.

- 1 DEFINITIONS
Account – the free of charge function of the Store (service) regulated by these Terms and Conditions, using which the Buyer may register their individual Account at the Store. Buyer – every entity making purchases at the Store. Store – the Carcosmetics online store operated by the Seller at the address https://www.carcosmetics.pl Seller – Przemysław Szukała, entrepreneur operating a business enterprise under the name Przemysław Szukała PRIMEX, entered into the Business Activity Central Register and Information Record kept by the competent minister for economy and operation of the Business Activity Central Register and Information Record, Tax ID 9720491864, ul. Drobnika 1, 60-369 Poznań.

- 3 TECHNICAL REQUIREMENTS
The proper functioning and set-up of an Account requires:
an active e-mail account
a device with Internet access
an Internet browser with support for JavaScript and cookie files
- 4 ACCOUNT
Registration of an Account is completely voluntary and dependent on the Buyer’s will, however, it is simultaneously required to make purchases at the Store.
The Account provides the Buyer with additional possibilities, such as: browsing the history of orders placed by the Buyer, reviewing the status of an order or ability to individually edit the Buyer’s data.
In order to register an Account, the User must fill out an appropriate form on the Store’s website.
Upon registration of an Account, a contract between the Buyer and the Seller is concluded for an indefinite period, concerning the operation of the Account according to rules specified in these Terms and Conditions.
The Buyer may terminate the Account at any given time without incurring any costs.
In order to terminate an Account, the User must send their resignation to the Seller at the e-mail address: kontakt@przewozybus.pl, which will result in the immediate deletion of the Account and termination of the contract concerning Account operation.
- 5 COMPLAINTS
Complaints concerning the functioning of the Account should be directed at the e-mail address kontakt@przewozybus.pl.
Processing of complaints by the Seller shall take place within up to 14 days.

- 7 RESERVATIONS
The Buyer is not allowed to submit content of an illegal nature.
The contract concerning registration of the Account is concluded in Polish.
In the event of significant causes specified in item 4, the Seller has the right to amend these Account Terms and Conditions.
The significant causes mentioned in item 3 above are:
the need to adapt the Store to comply with legal regulations applicable to the Store’s operation
improvement of the safety of rendering services
modification of the Account functionality requiring amendment of the Account Terms and conditions.
The Buyer shall be notified of a planned amendment to the Account Terms and Conditions at least 7 days prior to the effective date of the amendment via an e-mail message sent to the address assigned to the Account.
If the Buyer does not accept the planned amendment, they should notify the Seller of this fact by sending a corresponding message to the Seller’s e-mail address: kontakt@przewozybus.pl, which will result in termination of the Account operation contract effective on the date of the planned amendment or earlier, if so requested by the Buyer.
If the Buyer does not raise an objection to the planned amendment prior to its effective date, it is assumed that the Buyer accepts said amendment, which does not constitute an obstacle to terminating the contract in the future.
In the event of a possible dispute with a Buyer who is not a Consumer, such disputes shall be settled by a court of appropriate jurisdiction over the registered office of the Seller.
No provision of these Terms and Conditions excludes or in any way limits the Consumer’s rights arising from legal regulations.
